Article 1 – Purpose and scope
These general terms and conditions of sale (T&Cs) apply to all sales concluded on the website hanaoutdoors.com between SAS Design Sourcing Distribution France, a simplified joint-stock company (société par actions simplifiée) with share capital of €1,200, registered with the Saint-Nazaire Trade and Companies Register (RCS) under number 888 059 839, with its registered office at 32 avenue Georges Clémenceau, 44380 Pornichet, France. Intra-community VAT number: FR33888059839 (hereinafter “HANA Outdoors”) and any natural person acting as a consumer (hereinafter “the Customer”). They are available on the website at all times and are accepted by the Customer before confirming their order. The applicable T&Cs are those in force on the date of the order.
Article 2 – Products
The essential characteristics of the products (dimensions, materials, pack contents, available sizes) are presented on each product page. Photographs are as accurate as possible; slight differences in colour may appear depending on the screen used. Products are offered while stocks last; availability is shown on the product page.
Article 3 – Prices
Prices are shown in euros, including all taxes (VAT included). In accordance with the rules on distance selling within the European Union, the VAT applied is that of the Customer’s country of delivery; HANA Outdoors declares and pays it via the VAT One-Stop Shop (OSS). The price including VAT may therefore vary depending on the country of delivery; the final amount, including VAT, is shown before the order is confirmed. Delivery charges are shown before the order is confirmed and added to the total. Delivery charges amount to €9.99 for any order under €200 and are free for orders of €200 or more. HANA Outdoors may change its prices at any time; the applicable price is the one displayed when the order is confirmed.
Article 4 – Ordering
The Customer selects the products, checks the contents of their cart and the total price, chooses their delivery and payment methods, accepts these T&Cs and then confirms their order using a button clearly indicating the obligation to pay. A confirmation e-mail summarising the order, together with these T&Cs and the withdrawal form, is sent to the Customer. HANA Outdoors reserves the right to cancel an order in the event of an existing dispute with the Customer or suspected fraud.
Article 5 – Payment
Payment is due when the order is placed. Accepted payment methods are bank card, Apple Pay, Google Pay and bank transfer. For payment by bank transfer, the order is prepared once the funds have been received. Payments are processed securely by our payment providers; HANA Outdoors never has access to bank card numbers.
Article 6 – Delivery
Products are delivered to the address given by the Customer when ordering, within the areas and according to the methods, rates and times presented before the order is confirmed and on the Shipping and returns page. Products are delivered to the following countries: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Estonia, Finland, France (mainland France, including Corsica), Germany, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Romania, Slovakia, Slovenia, Spain and Sweden. French overseas departments and territories are not served. Orders are prepared within one working day. Parcels are delivered by DPD or GLS, within 24 to 48 working hours in France and within 24 hours to 4 working days in the other countries; bulky items shipped on a pallet are delivered by GEODIS, in France only, within 24 to 48 working hours. These times run from dispatch. Failing any indication, delivery takes place no later than 30 days after the order. The Customer is invited to check the condition of the parcel on receipt and to report any problem to the carrier and to HANA Outdoors as soon as possible. Risk passes when the Customer, or a third party designated by them, takes physical possession of the products.
Article 7 – Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to give reasons or bear any costs other than those provided for below. Where several products ordered together are delivered separately, the period runs from receipt of the last product.
To exercise this right, the Customer may:
- use the online withdrawal function “Withdraw from contract here”, available at any time from the button shown on every page of the website, without creating an account: the Customer enters their first and last name, order number and e-mail address, then validates the request using the “Confirm withdrawal” button;
- or send us the withdrawal form below, or any other unequivocal statement, by e-mail to info@hanaoutdoors.com or by post to 32 avenue Georges Clémenceau, 44380 Pornichet, France.
An acknowledgement of receipt of the withdrawal, setting out the content of the request and the date and time it was sent, is sent to the Customer by e-mail.
The Customer returns the products without undue delay and no later than fourteen (14) days after communicating their decision, to the following address: SAS DSD France, 4 rue du Pré Malenpogne, 44740 Batz-sur-Mer, France. Return costs are borne by the Customer. Products must be returned complete, with their accessories and, as far as possible, in their original packaging; the Customer may be held liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products.
HANA Outdoors refunds all sums paid, including the initial delivery charges (on the basis of the standard delivery method), no later than fourteen (14) days after receiving the withdrawal decision, using the same means of payment as for the order. The refund may be withheld until the products have been received back or until proof of their dispatch has been supplied.

Article 8 – Legal guarantees
All products sold benefit from the legal guarantee of conformity (Articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The legal guarantee of conformity benefits consumers; it does not apply to products purchased for professional use. HANA Outdoors does not offer a commercial guarantee in addition to these legal guarantees.
The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the trader, where applicable, to supply all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for giving back the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the goods are delivered back in working order.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who in bad faith obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for giving back the goods.
For any claim under the guarantees, the Customer contacts customer service at info@hanaoutdoors.com, quoting their order number and attaching, if possible, photos of the defect. No claim is refused on the basis of a fully automated decision.
Article 9 – Customer service
Customer service can be reached by e-mail at info@hanaoutdoors.com, by phone on +33 6 46 89 73 71 from Monday to Friday, 9 am to 5:30 pm, or by post at 32 avenue Georges Clémenceau, 44380 Pornichet, France.
Article 10 – Personal data
The data collected when ordering are necessary to process the order. Their use and the Customer’s rights are described in the privacy policy.
Article 11 – Mediation
In the event of a dispute, the Customer first sends a written complaint to customer service. Failing an amicable solution, and in accordance with Articles L611-1 et seq. of the French Consumer Code, the Customer may refer the matter free of charge to the consumer mediator: Médiateur de la consommation FEVAD (e-commerce mediator), BP 20015, 75362 Paris Cedex 8, France — www.mediateurfevad.fr, within one year of their written complaint.
Article 12 – Governing law
These T&Cs are governed by French law. This clause does not deprive a consumer Customer residing in another Member State of the European Union of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute, the Customer may bring proceedings before the court of the place where they lived at the time the contract was concluded or the harmful event occurred.
